Asbestos certificate in Catalonia: Law 8/2026

Preparing a sale or rental involves coordinating paperwork, property access and dates. Law 8/2026 of 2 July on asbestos eradication adds an issue to review before signing: information on the presence or absence of asbestos. What Law 8/2026 provides

The commencement date stated in the BOE is 3 October 2026. Article 21 regulates the certificate in the context of property sales and rentals. Applying the obligation to a specific transaction requires consulting the legal text and current official clarifications; a headline or social media post is not enough.

What the ARC currently clarifies

The Agència de Residus de Catalunya identifies its application as covering properties built before 2002. During the transitional period, the basic template records visible elements, condition and risk assessment. For an individual unit, the inspection covers that unit, not automatically all communal building elements. Information and scope must be reviewed if further clarifications or implementing regulations appear.

Inspection is not analysis or removal

Visual observation may identify a material that could contain asbestos, but does not by itself prove its composition. Confirmation may require laboratory analysis with a separate scope and quote. Areas that could not be inspected must also be documented.

EFITECNIC inspects and certifies: it does not remove or disturb asbestos and does not present itself as a RERA-registered contractor. If a suspect element is identified, issuing the certificate must not be confused with carrying out work on that material.
